China Investment and Trade  – Our Approach

China Experienced – Access to an International Law Department
  • We offer an “in-house equivalent” international legal team for China

    • Consistent with our approach in other international markets, companies expanding into China gain access to an in-house international law department for their China trade and investment legal needs – this is the approach of choice for many of the world’s largest companies

    • Each of our team members has had significant experience with investment and trade in China

    • Each of our team members has held senior international counsel roles with major companies, including with responsibility for China

  • While the core of our team is based in Chicago, the team includes a colleague based in Hong Kong and a colleague who was the former head of international legal affairs for Motorola during the period of its groundbreaking direct investments in China

In Addition to Hong Kong, Local Back-Up Support from Shanghai and Beijing

  • To help ensure that our advice is absolutely current according to the written law and (more importantly) the practical application of law in China, we also rely on on-the-ground support of select Chinese local lawyers based in Shanghai and Beijing

    • China restricts foreign lawyers based in China from practicing Chinese law – the practice of Chinese law is reserved to admitted Chinese lawyers practicing with local Chinese law firms

    • While an increasing number of US law firms are opening offices in Shanghai and Beijing, such firms must themselves turn to Chinese law firms for back-up support

    • We believe that our team of in-house experienced lawyers, including one based in Hong Kong, offers the right balance of benefits for our clients, including cost-effectiveness

    • The combination of a seasoned team of in-house lawyers supported by local Chinese lawyers is just the approach successfully followed by many leading companies

Industry and Activity Focus

  • We focus on five major areas of trade and investment in China:

    • Manufacturing and supply chain issues, including through direct investment in China and contractual arrangements with Chinese companies

    • Distribution, including retailing, agent and distributor arrangements and the establishment of trading companies

    • China Web site and e-commerce compliance, including laws related to content, advertising, publishing, terms and conditions and registration of Web sites

    • Biotech, pharmaceutical and other life science matters, including through direct investment and collaboration arrangements

    • Electronics, including telecommunications equipment, semiconductors and consumer electronics
